1. Payment Terms
a) Pay by Credit Card/Debit card ( Master/Visa), COD and Internet Banking such e.g maybank2u, cimbclicks
a) Unless specified otherwise, all prices and quotations are expressed to be GST INCLUSIVE amounts.
b) If GST is payable in respect of anything supplied to the Customer under this Agreement, then the amount which the Customer is obliged to pay for that supply (Original Amount) will (subject to the receipt of a valid tax invoice) be grossed up so that it results in, HELPY SDN BHD retaining the Original Amount plus any GST amount.
3. Complaint and Warranty
a) The only conditions and warranties which are binding on, HELPY SDN BHD in respect of the state, quality or condition of goods and services supplied by HELPY SDN BHD. (Customer Protection Act 1999)
b) To the extent permitted by statute, the liability, if any, of HELPY SDN BHD is, at, HELPY SDN BHD option, limited to and completely discharged by the resupply of the Service., HELPY SDN BHD is not responsible for:
- Not completing or providing the Service as a result of a breach of our Customer Service Agreement by the Customer (including a failure by the Customer to provide proper locations, utility services, a safe working environment or unencumbered access to the Premises); or
- Any damages caused by defective provided by the Customer;
- Any loss or damage incurred by the Customer or any third party as a result of the effects of a force majeure, being any event beyond the reasonable control of, HELPY SDN BHD
- Not completing or providing the Service due to an act or omission of the Customer or any other person at the Premises during provision of the Service;
- Any loss incurred as a result of any breakage or damage to goods, items of value (including antiques, items of sentimental value) or the Premises; or
- The cost of any key replacement or locksmith fees, unless keys were lost by, HELPY SDN BHD staff members.
- Except as provided in this clause, all conditions and warranties implied by law in respect of the state, quality or condition of the Service which may apart from this clause be binding on, HELPY SDN BHD are excluded.
- The Customer acknowledges that the results of any services provided may vary depending on a number of factors (equipment providing, packages and rates of services)
4. Cancellation Fees or Penalty.
a) If a HELPY representative fails to attend the Premises/Location within 40 minutes of the Service Time and does not provide the requested Service HELPY SDN BHD will provide the Customer with either:
I. A full refund of payments made by the Customer; or
II. Offer to reschedule the Service at another time mutually agreed between the Customer and, HELPY SDN BHD
5. Termination and Suspension
a) This Agreement may be terminated by the Customer by providing immediately after service.
b) HELPY SDN BHD may terminate this Agreement by providing the Customer immediately after service.
c) HELPY SDN BHD may terminate this Agreement with immediate effect if the Customer is in breach of this Agreement, and in the opinion of, HELPY SDN BHD that breach is incapable of remedy.
d) HELPY SDN BHD reserved for immediately suspend or terminate its service to the user without warning or notice for violation of any related term and condition apply.
e) HELPY SDN BHD also reserved to take an action under Section 2 of the Employment Act 1955 if related to sexual harassment during service to user.
a) The Customer acknowledges that any information provided by the Customer may be used by HELPY SDN BHD for providing the Service. HELPY SDN BHD agrees not to share any information provided by the Customer with any third party not directly involved in the provision of the Service (unless required to do so by law).
b) The Customer agrees to, HELPY SDN BHD communicating with them electronically and/or via other means in order to provide the Service or for reasons related to the provision of the Service.
c) HELPY SDN BHD will take all reasonable precautions to protect personal information provided by the Customer from loss, misuse, unauthorized access or disclosure, alteration or destruction.
d) Any of your information, including Geo-location data, you upload, provide, or post on the HELPY platform may be accessible to certain spaces in the HELPY platform. We cannot verify or guarantee the accuracy of the information a poster provides us on the HELPY platform, and we do not control the information provided by other posters that is made available through our system. Therefore, HELPY cannot and does not confirm each poster's purported identity. You may find another poster's information to be offensive, harmful, inaccurate, or deceptive. Please use caution and common sense when using the HELPY platform.
Please note that there are also risks of dealing with underage persons or people acting under false pretense. By using the HELPY platform, you agree to accept such risks and HELPY is not responsible for the acts or omissions of others on the HELPY platform. In order to help you evaluate with whom you are dealing, HELPY can link to a poster's facebook.com profile if they supply us with their facebook.com account information.

7. Subject to Changes
a) HELPY SDN BHD reserves the right to update or modify these terms and conditions at any time without prior notice, and may do so by publishing an updated agreement on its website. Each updated agreement will take effect 24 hours after it has been published on the website. b) HELPY SDN BHD may increase the commission payable at any point in time. If you continue to use HELPY SDN BHD, you shall be deemed to have accepted the new cost for that renewal term and any subsequent renewal terms
8. Copyright the content of this Agreement
a) Protected by international copyright laws and may be used for personal reference only. Subject to applicable law, permission to copy, alter, reproduce, and publish, transmit and/or otherwise distribute this content is forbidden without first obtaining the prior written permission of HELPY SDN BHD. Referring Copyright (Copyright Tribunal) Regulation 2012 and (“Content”) are works protected under the Malaysian Copyright Act 1987.
b) HELPY SDN BHD takes no responsibility for its contractors or subcontractors in any way or form. HELPY SDN BHD has the right to report non-payment of services to either the Police or a credit reporting agency as it sees fit., HELPY SDN BHD have the right at any point to review its customer Service agreement and make changes where it sees fit.
9. Social media and networking sites
a) As part of the functionality of the HELPY platform, you may be able to login through online accounts you may have with third party service providers (each such account, a “third party account”) by either providing your third-party account login information through the HELPY platform; or allowing HELPY to access your third-party account, as is permitted under the applicable terms and conditions that govern your use of each third party account.
b) You represent that the HELPY platform is entitled to disclose your information in the HELPY platform, social media and its networking sites, without breach by you of any of the terms and conditions that govern your use of the applicable third-party account and without obligating HELPY to pay any fees or making HELPY subject to any usage limitations imposed by such third-party service providers. By granting HELPY access to any third party accounts, you understand that HELPY may access, make available and store (if applicable) any content that you have provided to and stored in your third party account (the “social networking site/sns content”) so that it is available on and through the HELPY platform via your account, including without limitation any friend, contacts or following/followed lists, and HELPY may submit and receive additional information to your third party account as indicated herein.
10. Helpy e-mail and text communications
a) E-mail communications and text messages sent from or through the HELPY platform are designed to make your HELPY experience more efficient. By becoming a poster, you specifically agree to accept and consent to receiving e-mail communications and text messages initiated from us or through us, which include, without limitation: message notification e-mails, e-mails or text messages informing you about potential available HELPY apps or posters and e-mails informing you of promotions we run and emails informing you of new and existing features we provide. Standard text messaging charges applied by your cell phone carrier will apply to text messages we send. If you change your mobile phone service provider, the notification service may be deactivated for your phone number and you may need to re-enrol in the notification service. b) HELPY reserves the right to cancel the notification service at any time. If you do not wish to receive any of our e-mail communications or text messages, please do not use the services or sign up in the HELPY platform.
11. Online content disclaimer
a) Opinions, advice, statements, offers, or other information or content made available through the services, but not directly by us, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. We do not guarantee the accuracy, completeness, or usefulness of any information on the services and neither do we adopt nor endorse nor are we responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than us.
b) Under no circumstances will we be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on the services, or transmitted to posters. We reserve the right, but we have no obligation, to monitor the materials posted in the public areas of the services. Notwithstanding this right, you remain solely responsible for the content of the photos, profiles (including your name, image, and likeness), messages, notes, text, information, music, video, advertisements, listings, and other content (the "content") that you post in the public areas of the services and in your private e-mail messages.
c) We shall have the right to remove any such material that in our sole opinion violates, or is alleged to violate, the law or this agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of posters or others. E-mails sent between you and other posters that are not readily accessible to the general public will be treated by us as private to the extent required by applicable law.
d) In the event that you have a dispute with one or more posters, you agree to release HELPY (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected to such disputes with other posters or to your use of the HELPY platform or the services. In other words, you are solely responsible for your interactions with other posters. We reserve the right, but have no obligation, to monitor disputes between you and other posters. Please carefully select the type of information that you post on the HELPY platform or through the services or release to others. We disclaim all liability, regardless of the form of action, for the acts or omissions of other posters or posters (including unauthorized posters, or "hackers"). HELPY only offers a venue that enables HELPY and posters to match with each other. HELPY does not offer delivery services and HELPY is not a delivery company. We are not involved in the actual delivery provided by HELPY to posters. As a result, we have no control over the quality or reliability of the delivery that occurs as a result of the service; nor do we have any control over the truth or accuracy of the of posters' information listed on the HELPY platform. We cannot ensure that a HELPY or poster is who he or she claims to be or that a HELPY or poster will actually complete an arranged service. We reserve the right to change any and all content, software and other items used or contained in the HELPY platform and the services at any time without notice. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by HELPY or the HELPY platform.
e) The HELPY platform and the services may be temporarily unavailable from time to time for maintenance or other reasons. HELPY assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, poster communications. HELPY is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the internet, on the HELPY platform, on any web site or any combination thereof, including injury or damage to poster's or to any other person's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the web and/or in connection with the services.
